Rutherford County, for us, means the Hickory Nut Gorge: Lake Lure, Chimney Rock, and the Rutherford side of Bat Cave. Fifty minutes from the Asheville yard on US 74A, and the last ten are the gorge road that Helene rebuilt. The permit picture has a twist: the county is state ground, but the Town of Lake Lure runs its own erosion program inside town limits.
Who reviews an erosion plan in Rutherford County?
Two answers. Outside Lake Lure, the state. Rutherford County isn’t on DEMLR’s contact list of delegated local programs, revised May 15, 2025 (DEQ contact list), so plans go to the Asheville regional office at the state trigger of 1 acre, filed 30 days ahead (DEQ erosion rules). The state fee is posted with the application (DEQ application page).
Inside the Town of Lake Lure, the town. Lake Lure appears on that same DEMLR list as a delegated program with its own program administrator. The DEQ fee listing doesn’t carry a Lake Lure threshold or fee, so we don’t print one. Ask the town before you size a lakeside job. Neither the county nor the town has published a steep slope percentage for grading (Rutherford County). In the gorge the slopes are the reason the lots failed, so the missing rule is a design problem for us, and we read the grade above every pad.
Burning and the trout strip
Open burning needs an NC Forest Service permit through the Rutherford County ranger, and land-clearing debris on more than 5 contiguous acres needs the special permit (NC Forest Service permits). Rutherford drains to the Broad. The Rocky Broad through the gorge and its headwater creeks carry designated trout water, so the 25 foot undisturbed strip from top of bank applies on most gorge lots. Check the reach on the DEQ classification schedule. On the river we mulch in place and leave the chips on the bank.
Where Helene still shapes the work
Everywhere in the gorge. Chimney Rock village lost its main street to the Rocky Broad, and Bat Cave’s access road reopened after 18 months. Lake Lure’s private property debris page says the federal program is closed to new applicants, with Army Corps crews finishing registered parcels, staging at the fire department, and giving owners 72 hours’ notice before work (Lake Lure PPDR updates). The state SMART program lists Rutherford County with the same eligibility rules as the federal one (SMART roster).
A lot that never registered is storm cleanup at the owner’s cost, and in the gorge that means an excavator and a rebuilt bank from the owner’s grading contractor before it means a pad. The state’s landslide hazard mapping doesn’t yet cover Rutherford the way it covers Buncombe and Henderson, so we read the slope above a scar ourselves (NC Geological Survey). Ground and access across the county
The gorge is a one-lane problem. Chimney Rock and Bat Cave lots have US 64 and US 74A for access and nothing else, with no place to turn a dump truck and a river on one side. Tracked machines, walked-in carriers, and a haul plan that works around the road crews. Lake Lure’s north shore and the Buffalo Creek side are gentler, with paved subdivision roads that take a lowboy. Off the lake, a grading contractor stages the wall and the cover the same week a bank is opened (landslide damage, clearing, and stabilizing).
Pull the parcel on the county GIS and check whether it sits inside the Lake Lure town limit. That one line decides which office you call.
